Affiliate Program Terms

 

I. Flipsnack Affiliate Program

1. Scope

This Flipsnack Affiliate Program ("Program") outlines the terms and conditions governing your participation as an affiliate partner. The Program enables affiliates to promote Flipsnack through approved HTML links placed on their websites. These Terms encompass the rights, responsibilities, and obligations of each party, where "we," "us," "our," or "Flipsnack" refer to Flipsnack.com, and "you" or "Affiliate" refer to the individual or entity applying to join the Program. For these Terms, a Customer is defined as an individual or entity completing a purchase through the affiliate’s referral link, and a Commission is the fee paid to the affiliate for each qualifying transaction made by a Customer. These Terms establish a framework for affiliates to earn commissions by referring valid customers to Flipsnack through compliant marketing practices.

2. Affiliate Obligations

2.1. Enrollment in the Program

To join, complete and submit the online application at flipsnack.com/affiliate-program. We manually review each application and reserve the right to accept or reject it at our discretion. Grounds for rejection may include, but are not limited to, sites that:

  • Promote sexually explicit content, violence, illegal activities, or discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age;
  • Infringe third-party intellectual property rights;
  • Misuse "Flipsnack" or similar misspellings in the domain name; or
  • Contain content we find harmful, threatening, defamatory, obscene, harassing, or objectionable.

Affiliates must avoid misrepresenting Flipsnack or implying an association beyond this Program. Prohibited conduct includes sending unsolicited commercial emails (spam), posting in non-commercial newsgroups, excessive cross-posting, misleading advertisements, or using deceptive tactics like cloaked URLs to redirect traffic to Flipsnack without clear disclosure.

2.2. Compliance with Data Protection Laws

Affiliates must comply with applicable data protection and privacy laws, such as the General Data Protection Regulation (GDPR) and, if relevant, the California Consumer Privacy Act (CCPA). This includes implementing measures to ensure the security and confidentiality of personal data collected through the Program. Specifically, affiliates must:

  • Obtain appropriate consent before collecting, using, or sharing personal data, in line with their privacy policy;
  • Use data solely as permitted under these Terms and not for unauthorized purposes;
  • Promptly notify Flipsnack of any data breaches or incidents compromising personal data security; and
  • Adhere to any additional data protection guidelines issued by Flipsnack.

Flipsnack reserves the right to monitor affiliate websites and promotional activities to ensure compliance with these Terms and may request modifications to align with our standards.

2.3. Ongoing Affiliate Responsibilities

Affiliates are responsible for ensuring their website and activities remain compliant with applicable laws and these Terms. Only Flipsnack-provided tracking links and dashboards may be used to track sales, leads, and customer interactions accurately. Flipsnack reserves the right to review affiliate sites and may request adjustments to promotional content to align with our branding standards.

3. Commission Structure

Affiliates earn a 20% commission on sales completed through their referral link, provided the referred customer finalizes their purchase, and Flipsnack receives full payment.

Note: Commissions are not awarded for refunded, canceled, or unpaid transactions within 30 days, and commissions already paid on such transactions will be deducted from future earnings.

Commissions are processed every 30 days, with any refunds deducted before payout. Commissions are tracked in the Rewardful affiliate dashboard and become payable once the total owed meets or exceeds $50. Payments are made through third-party processors like Rewardful or PayPal, with affiliates responsible for complying with each platform’s terms and conditions. Flipsnack is not liable for fees imposed by these payment platforms.

If Flipsnack detects fraudulent activity in referred sales after commissions are paid, adjustments may be made. Flipsnack reserves the right to withhold or reclaim commissions associated with fraudulent transactions.

4. Promotion Restrictions

Affiliates may promote their websites, but all references to Flipsnack must clearly indicate that the promotions are independent of Flipsnack. Affiliates must not imply a direct partnership beyond this Program.

Affiliates are prohibited from bidding on keywords like "Flipsnack" or "Flipsnack.com," including variations or misspellings, in PPC campaigns (e.g., Google Ads). Unauthorized use of these keywords in campaigns is a violation of our trademark policy, and violators may be removed from the Program.

Affiliates may submit leads through referral forms and are responsible for their accuracy and legitimacy. Fraudulent lead submissions may result in Program termination and forfeiture of commissions. Affiliates are also prohibited from using Parasiteware™, Parasitic Marketing, or deceptive software tools that overwrite tracking cookies or mislead users. Techniques like pop-ups, hidden links, and IFrames that interfere with Flipsnack’s branding or tracking mechanisms are strictly forbidden.

Affiliates may not imitate the look and feel of the Flipsnack website. Any attempt to create a similar website, including copying its layout, design elements, or branding, is prohibited and may lead to immediate termination from the Program.

5. Grant of License

Flipsnack grants affiliates a non-exclusive, revocable license to link to our site and use logos, trade names, and trademarks for promoting Flipsnack per these Terms. Affiliates agree not to use Flipsnack’s name or licensed materials in ways that are defamatory, misleading, obscene, or damaging to our brand.

6. Termination

Either party may terminate participation in this Program by providing written notice, with termination becoming effective upon delivery of that notice.

Flipsnack reserves the right to terminate your affiliate account immediately if any breach of these Terms occurs, including actions such as spam, blackhat SEO tactics, violations of data protection laws, fraudulent behavior, or any misrepresentation of our brand. In such cases, any pending commissions will be forfeited.

Additionally, Flipsnack may terminate accounts that show inactivity or low performance if no meaningful traffic or conversions are generated within a designated period.

7. Program Terms

The Flipsnack Affiliate Program is governed by Flipsnack's Terms of Service. By participating, affiliates agree to these Terms and any additional conditions of the Program.

Flipsnack reserves the right to modify, amend, or discontinue the Program at any time in compliance with applicable laws. Affiliates are responsible for regularly reviewing updates to these Terms.

 

II. Enterprise Referral Partner Program

Flipsnack offers a specialized Enterprise Referral Program for partners who refer large businesses or organizations to our Enterprise plans. This program operates under terms distinct from the standard affiliate program and general Terms and Conditions, tailored specifically for larger referrals.

 

1. Eligibility and Approval

To participate, partners must meet specific eligibility criteria, including referring businesses that align with Flipsnack’s Enterprise plan requirements and employing approved lead-generation strategies such as direct outreach or consulting. Referrals must be submitted through Flipsnack’s Enterprise referral portal for pre-qualification. Flipsnack reserves the right to approve or reject any partner based on the quality and fit of their referrals. Interested partners should contact affiliate.support@flipsnack.com to initiate the participation process.

 

2. Lead Qualification and Commission

Only leads that Flipsnack’s sales team approves qualify for commissions. The lead qualification process involves:

  • Initial Lead Submission: Submission through the Enterprise referral portal.
  • Verification: Evaluation to ensure the business meets Enterprise plan criteria.
  • Acceptance: Final acceptance by Flipsnack for tracking and commission eligibility.

Referral partners are eligible for a custom commission structure, which may include either a percentage of the sale value or a flat fee. Commissions are awarded on deals closed within 12 months of referral submission, provided they meet the Enterprise plan’s minimum pricing threshold and the referred client’s payment is confirmed after the 30-day refund period.

 

3. Tracking and Support

All Enterprise referrals must be submitted through the designated portal or coordinated directly with Flipsnack’s referral team. Internal tracking and attribution will manage the referral status, and updates will be provided to partners as needed. Flipsnack offers customized marketing materials and dedicated account management to assist partners in pitching to larger organizations and ensuring smooth collaboration.

 

4. Termination

Flipsnack reserves the right to terminate any Enterprise referral partnership at its discretion if these Terms are violated or if referred leads are deemed unsuitable for the Enterprise plan.
